Please read this section carefully. It sets out your agreement with us and contains important terms designed to protect your interests, and to aid you in understanding how your agreement with us works.
1. Terms
The "us" or "we" refers to Bike Bus.
The "you" or "your" refers to those named on the Reservation Form.
2. Your Agreement with Us
Your agreement with us begins when you confirm your reservation and/or when you sign the declaration form presented to you at the time of hiring.
Your agrement with us ends when you have returned all the equipment hired and settled all debts to Bike Bus.
3. Our Responsibility
a) We promise to supply you with equipment in accordance with the reservation form and of a quality and condition suited to the purpose intended and as advertised on all our promotional media.
b) If we are hiring equipment out to you then subject to these terms and conditions and your reservation form, we accept responsibility should you or any member of your party suffer personal injury, illness, loss or damage, or death as a direct result of any failure to perform, or improper performance of any part of this equipment, our services, and by any of our suppliers of services (providing they were at the time carrying out work authorised by us), except in the following situations:
We are not liable where any failure to perform or improper performance
was due to:
I. Force majeure,
II. The acts/omissions of the person affected,
III. The acts/omissions of a third party not connected with our agreement,
IV. Events which we could not have foreseen or avoided even with all due care and attention.
It is a condition of your acceptance of our claim of responsibility, that you notify us of any claim that you or any member of your party has with us, in accordance with the Complaints Procedure (Clause 7) and that you provide us and our insurers with any assistance we may reasonably require.
4. Your Responsibility
a) The Declaration Form (signed by you on delivery), your Reservation Form and these Conditions contain all the details of your agreement with us. It is your responsibility to check these and advise us of any inaccuracy before accepting them by signing the Declaration Form.
b) Upon release of equipment to you for hire, we will verify together its condition and you will be required to sign the Declaration Form thus accepting responsibility for the items hired in the condition given.
The Hire Declaration reads:
"I am happy that the equipment supplied is in good condition and of a suitable size and quality. I agree that for the hiring period I am responsible for the return in reasonable condition of all goods hired. I sign in accordance with this for myself and on behalf of my group. I am at least eighteen years of age."
If you elope with the bikes and/or damage them beyond reasonable wear and tear, penalty fees corresponding to the whole or part value of the equipment hired will become due. (Clause 6c)
c) You accept responsibility for any damage, injury or loss caused by you or any member of your party, to anything or anyone connected or not with our agreement.
d) Outdoor activities can be hazardous if you behave foolishly, so don't take risks. In the interest of safety, you undertake to follow our advice and that of our suppliers, to comply with any local codes of conduct, to adhere to the countryside code and to act sensibly and prudently at all times.
f) We expect you to have consideration for others.
If in our opinion, or in the opinion of any other person in authority, you or any member of your party behaves in such as way as to cause or to be likely to cause danger, annoyance or distress to any third party, or damage to property, then we are entitled, without prior notice, to terminate our contract with you.
If this is the case:
I. You will be required to return all equipment hired immediately.
II. You must settle any outstanding debts concerned with your agreement with Bike Bus.
III. You must settle any debts concerning damage, injury or loss caused by you or any member of your party, to anything or anyone connected or not with our agreement.
IV. We will have no further responsibility toward you.
V. No refunds shall be made.
VI. Expenses or costs incurred as a result of termination are all payable by you.
g) It is your responsibility to properly insure yourself and all members of your party for the activities which you will undertake to do during your time with Bike Bus. We do not offer alternative personal insurances.
5. Roadside Assistance
Roadside Assistance is FREE within a 30km radius of Hub#1 at Castelnaud for bikes hired from us, or you can purchase assistance if you intend travelling beyond 30km but up to 100km from Castelnaud. You can select this service from the options on your reservation form.
30km Roadside Assistance (FREE). This service is intended for technical repairs and adjustments to our bikes and not for fixing punctures. Upon your departure, you will be offered a pump (included in the hire price and returnable at the end) and the opportunity to buy a tyre kit (tyre levers, inner tube, and repair kit supplied in a sealed bag). If you do not use the kit and the sealed unit is unopened, it can be returned to us and we will refund its purchase cost. If you require a puncture repair demonstration, please ask us at the beginning of your tour.
When you call us for Roadside Assistance, depending on the severity of each individual case, we will either spend time talking you through a simple fix over the phone, or we will travel out to you to fix or replace your bike(s). Upon arriving at your bike, we will assess its condition together with you, fix or replace, then recheck the bike's condition making sure it is now safe to ride. Our travel expenses and labour are free of charge for this service. Replacement parts, however, are chargable to you at cost.
Beyond 30km, Roadside Assistance is payable.
100km Roadside Assistance (10 euros per person)
If you intend to travel further afield or you have brought your own bikes, you can purchase roadside assistance for up to 100km radius from Hub#1 at Castelnaud. You get all the services as for the 30km roadside assistance extended to 100km. If you have brought your own bike, the replacement bike service is only available at cost (ie rental fees apply).
Without Roadside Assistance
If you do not purchase Roadside Assistance, but you do have the occasion to call us out whilst beyond the 30km zone, the fee will be based on the distance travelled from Hub#1 at Castelnaud, our labour and repairs at cost.
All call outs for puncture repairs are payable (travel + labour + parts)
6. Deposits
a) Confirmation Deposit
If the reservation form is exactly what you want, then to confirm, you must send 33% of the total cost as a deposit. This amount is calculated for you on your reservation form and must arrive before the start of your reservation. If it has not yet arrived, then the total amount is payable at the start of your tour. Should the deposit payment arrive late, and total payment has already been received, this late deposit payment will be refunded to you.
Your deposit can be paid either by :
I. PayPal - We will send you an email that will redirect you to their secure payment site. The amount displayed will be 33% of the total amount due for your reservation. You will have the choice to pay with your own PayPal account or by credit card. We are charged a fee by PayPal for this transaction but the amount that you pay is the amount on the reservation quote. This fee is important only for cancellations. (See clause 8)
II. Direct bank transfer - There may be extra fees payable depending on which establishment you bank with.
III. Cheque - Pounds Sterling or Euros (non-eu euro cheques are not accepted)
b) The Equipment Deposit :
From the moment you sign the Declaration Form, you are responsible for all equipment hired. As security for our equipment, we require either :
I. A copy of your passport and your credit card details. No transactions will be made on the credit card without your notification.
II. A copy of your passport and a deposit of 300 euros cash per bicycle hired.
Once you have returned all equipment hired in reasonable condition, credit card details shall be destroyed or the deposit shall be returned to you in full.
Should you return any/all of the equipment hired in unreasonable condition, penalty fees will become due. What constitutes 'unreasonable condition' is left to the discretion of Bike Bus and/or its representatives. Bike Bus's decision is final.
c) Penalty Fees :
When all your hired equipment has been returned to Bike Bus, its condition will be assessed be a Bike Bus representative. This will reveal either no damage and/or reasonable wear and tear, or unreasonable damage catagorised as structural and/or surface damage.
I. There are no penalty fees for no damage and/or reasonable wear and tear.
II. Unreasonable structural damage means an item has been rendered unusable and will have to be replaced. The penalty fee is 25 euros plus the full replacement cost of the item, be that of a single component or of the whole bike.
III. Unreasonable surface damage means that the item has sustained light damage which will reduce the resale value of the item. The penalty fee is 25 euros plus the depreciation value relative to the damage caused.
Penalty fees for unreasonable damage will be payable at the time of returning the equipment hired.
7. Alterations
a) Alterations made by you to your itinerary more than 2 weeks prior to the start date carry no charge, providing the number of alterations is considered by us, to be reasonable. Otherwise each subsequent alteration will carry a charge of 30 Euros.
b) Each alteration made by you less than 2 weeks before the start date carry a charge of 30 Euros. The balance of payment will be due at the start of your holiday.
8. Cancellations
a) For cancellations made by you greater than 2 weeks before the start date, you shall be fully refunded less a 10% administration fee.
b) For cancellations made by you less than 2 weeks before the start of your holiday, your 30% deposit shall be retained by us, unless you agree to postpone your reservation for a date later in the season.
c) For cancellations made by you during your holiday, the total reservation cost remains due, unless you agree to postpone your reservation for a date later in the season.
d) If due to circumstances beyond OUR control, we have to alter or cancel your itinerary at any stage, you will be contacted and given choice of a change of itinerary, or cancellation with full refund of monies paid to date. No further discussion will be entered into. Bike Bus's decision is final.
9. Complaints Procedure
Should you have reason to complain during your holiday with us, you must report it at the time to a Bike Bus representative to enable it to be put right. If you remain dissatisfied, you should put in writing and send it to Bike Bus within 28 days of your return, otherwise, we regret we cannot accept liability. Your agreement with us is made in Navenby and governed by British law and jurisdiction.
10. Special Offers
a) From time to time Bike Bus will make special promotion offers. To receive these benefits, you must quote the promotion reference code on first contact.
b) To receive promotion benefits, purchases of Bike Bus products and/or services may be necessary.
c) Promotion code 2008-BB10 = 10% off your bike rental provided :
i) You email us quoting the relevant promotion code
ii) Your reservation schedule is agreed by 31 March 2008
iii) The reservation deposit has arrived in our account by 10 April 2008
iv) At least one member of your party is an adult.
d) We reserve the right to refuse entry into this promotion.
11. Other
These Terms and Conditions may be altered at any time. All agreements confirmed previous to the amendments however, shall be honoured in full.
